Terms and Conditions

These terms and conditions act as a contractual agreement (“Agreement”) between you and Talk In Arabic (“Talk In Arabic”, “us”, “we”, “our”). This Agreement applies to your use of talkinarabic.com, app.talkinarabic.com and community.talkinarabic.com (together, the “Site”) and to any paid plan or Verb Pack you buy through it (each a “Membership”). By using this Site, you represent that you are at least 18 years old and legally competent to enter into this Agreement.

BY USING THE SITE, YOU AGREE TO THE MANDATORY ARBITRATION AND CLASS ACTION WAIVER DETAILED IN SECTION 15.

1. PRIVACY & ELIGIBILITY

Your privacy is important to us. Our Privacy Policy is incorporated into these terms by reference. This Site is directed at adults. If you are under 18, you may only use this Site with the involvement and consent of a parent or guardian.

2. MEMBERSHIPS & ACCOUNTS

  • Registration: You may register for a free account or upgrade to a paid Membership. You agree to provide accurate, current information when you register and in the Account Settings section of the Site.
  • One Account: You may only register for one account. Sharing accounts or login credentials is strictly prohibited.
  • Security: You are responsible for maintaining the confidentiality of your username and password. Notify us immediately of any unauthorized access.

3. PAYMENTS & REFUNDS

  • One-time Purchases: Lifetime plans and Essential Verb Packs (“Verb Packs”) are sold at the indicated prices as single payments. A one-time purchase gives you access to the content it covers, including later additions to that content, for as long as we make the Site available. It does not include content sold separately.
  • Recurring Charges: Yearly plans are billed on a recurring basis, on each anniversary of the date you signed up, until cancelled.
  • Refund Policy: We offer a 30-day money-back guarantee for initial Membership payments, including Lifetime plans and Verb Packs. After 30 days, refunds are issued at our sole discretion. Claiming “forgetting to cancel” is not a valid basis for a refund beyond the 30-day window.

4. CANCELLATION

You may cancel a yearly plan at any time. Your access continues until the end of the period you have paid for. Lifetime plans and Verb Packs are single payments, so there is nothing to cancel.

  • Stripe: Log in to the app and open Account Settings, then Billing, to stop future charges.
  • PayPal (legacy subscriptions only): Log in to your PayPal account and cancel the recurring payment to Talk In Arabic there, or contact us and we will cancel it for you.
  • Termination by Us: We reserve the right to terminate accounts that violate these terms. We may also delete any free account that has had no paid plan or Verb Pack for thirty (30) days after it was created; free content, including the Egyptian Arabic audiobook, is available while the account exists. If we cancel a paid Membership without cause, we will refund the unused portion of a yearly plan on a pro-rata basis, or, for a Lifetime plan or Verb Pack, an amount we determine reasonably in light of how long you have had access.

5. INTELLECTUAL PROPERTY LICENSE

We grant you a non-exclusive, non-transferable license to access the Site and view purchased content for your personal, non-commercial use. You may not copy, modify, distribute, sell, or create derivative works from our content without express written consent.

6. USER-GENERATED CONTENT

By posting to our forums or comments, you grant Talk In Arabic a worldwide, royalty-free, perpetual license to display and distribute that content. You represent that you own the rights to anything you post. We reserve the right to remove content that is unlawful, offensive, or violates third-party rights.

7. PROHIBITED CONDUCT

You agree not to:

  • Harass, bully, or stalk other members.
  • Spam members or use the site for unauthorized commercial solicitation.
  • Upload viruses, malware, or attempt to breach site security.
  • Scrape or “crawl” the site content automatically without our permission.

8. NO WARRANTIES

THE SITE IS PROVIDED “AS IS.” TALK IN ARABIC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALK IN ARABIC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THREE TIMES THE TOTAL FEES YOU PAID US IN THE PREVIOUS 12 MONTHS, OR $500, WHICHEVER IS GREATER.

10. INDEMNITY

You agree to indemnify and hold harmless Talk In Arabic and its representatives from any claims, losses, or legal fees resulting from your violation of these terms or your use of the Site.

11. AFFILIATE DISCLAIMER

Talk In Arabic is a for-profit site. We participate in affiliate programs (including the Amazon Services LLC Associates Program). If you purchase a product through an affiliate link, we may receive a commission at no extra cost to you.

12. DMCA & COPYRIGHT POLICY

We respect intellectual property. If you believe your work has been infringed, please submit a notice to us via our Contact Page. Your notice must include:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work.
  3. The URL of the infringing material.
  4. Your contact information.
  5. A statement of “good faith belief” that the use is unauthorized.
  6. A statement, under penalty of perjury, that the info is accurate.

We handle repeat infringers by terminating their account access.

We are not responsible for the content or practices of third-party websites linked from our Site. Use them at your own risk.

14. MODIFICATIONS

We may update these terms from time to time. We will notify you by posting the new date at the top of this page. Continued use of the Site constitutes acceptance of the updated terms.

15. DISPUTE RESOLUTION & ARBITRATION

PLEASE READ CAREFULLY. Any dispute arising from these terms will be settled by binding arbitration on an individual basis. You waive your right to a jury trial or to participate in a class-action lawsuit.

  • Opt-Out: You may opt-out of this arbitration agreement within 30 days of your first visit by contacting us in writing.
  • Governing Law: These terms are governed by the laws of Queensland, Australia, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought in the courts of Queensland.
